Netflix....what gives.


I am currently binge watching Quantum Leap on Netflix and there are several episodes missing? Does anyone know why?

I think its because of music rights. Just because they bought the rights to use the music in the broadcast doesn't mean they have the right to sell it on DVD; the licensing is different.

Universal Studios stupidly chose not to obtain the necessary music licensing for all of the music it used in the series. But, on my copy of "Quantum Leap: The Complete Second Season" Region 1 DVD; subsequent releases featured music replacements, with Universal's inclusion of a disclaimer on the package indicating as such (this disclaimer also began to appear on other releases of various other Universal series). They also failed to negotiate with the songwriters union, but I don't remember which one it was ASCAP or BMI. They have the rights to air them, just not distribute them on VHS or DVD and they generally have to pay the rights for its usage.

So, there are a great deal of television series and movies, who may have used Happy Birthday to You, there is an obscene licensing fees they had to pay for its usage. But I believe that someone filed a lawsuit about this in federal court to which the federal Judge determined that the song is public domain. The copyright originally filed by the Clayton F. Summy Co. in 1935 granted rights only to the melody and specific arrangements of the tune but not to the actual song itself, as Summy never acquired the rights to the song's lyrics.

Warner/Chappell Music has been enforcing the copyright claim since it bought Summy's successor, the Birch Tree Group, in 1988. It has made $2 million in royalties each year. The next step in the case will be whether they need to return the money they collected for its use. 

These things happen a lot, where a television series failed to negotiate the airing and distribution licensing fees. Its been so long since the series first aired that I don't think I could tell what the original song was used. But, it's why some episodes are missing on Netflix from what I heard.

I don't think music has anything to do with it since the DVDs don't have the original music.

If I had to guess, I would assume it's a way to force people to still buy the DVDs.

I know there were licensing issues with the music but again, that doesn't hold water in terms of the Netflix question since most of the episodes on the DVDs don't have the original music at all and there are plenty of episodes on Netflix that use the generic music the DVDs have utilized.

There are episodes of Sliders missing on Netflix also. Like I said, the best explanation is that they put a lot of episodes on there but leave some out so entice viewers to still purchase the DVDs.

Exactly. If they don't have the music rights for some songs you simply put the show on without those songs. I just think it's stupid to have a show on Netflix and not have all the shows.

It's not like you can just magically remove the music - it needed to be edited out without removing the dialog & other sounds. To really do it right, you need to go back to the original, unmixed tracks if possible.

I called NETFLIX before about this and never got a definitive answer but the rep stated that it could be an actor that wouldn't or couldn't give permission as well. Episodes of EMERGENCY! are missing and they never had any unoriginal music.

Not sure if this helps, but it looks like they're all on Hulu; no episodes missing.

'Disco Inferno' is missing -- if you look at Season 2 is skips from 'Honeymoon Express' to 'The Americanization of Machiko'. 'Disco Inferno' is supposed to come after 'Honeymoon Express' and it is on the DVDs. Hulu had it a few years ago but they removed it.

But everything else is there.

I watch all the episodes I can on Netflix, but for the rest (like the the pilot episode, Lee Harvey Oswald, the Finale, etc), I use Hulu.

I noticed last night that 'Quantum Leap' had 'New Episodes' listed, and sure enough, there they are! Looks complete now.

Why, because he never returned home? It was his choice. He chose to do what he really wanted to do. Getting home was always just Sam's excuse (and the show's excuse) to keep him going, because he wasn't ready to accept that helping people and doing what he was doing was what was driving him.

They just added all the missing episodes in!

All except 'Disco Inferno'. Not sure what the issue is with that episode but it still isn't on Netflix and it got removed from Hulu too. It's only available on the DVDs.

The two-part pilot isn't there as well, but it appears all the others have been added.
