I was born in 1988 and recently saw this movie a couple of weeks ago. I was blown away when they used the name "Harry Potter". That's not really a common name if you think about it.
If they DID make a remake, J.K. Rowling couldn't sue them because they had copyrights to the name first and if she sued then it would crash and burn in her face. No one has sued yet, so it probably isn't a big deal to them.

Based on WHAT exactly? That the creators of Troll had a time machine and traveled to the future, read her crappy, half-assed books and then went back to their own time to use the name Harry Potter for their main character? I don't think so... if they wanted to make a remake using that name, it would be their right to do so.
I doubt the creators of Troll would want to sue JK, but they would at least have a very very small chance of winning the case, instead of none at all.
