Couldn't the people who own the rights make Harry Potter movies?

I mean, if you would do a sequel to this or even a remake, you could start your own Harry Potter series, since the name is obviously already in this one and they could never sue you.
A bit like the Ghost Busters case.

Haha. I did a search on google. And guess what? "A remake of Buechler’s Troll has been talked about for years. It’s now being talked about again, and this time it’s been given the amazing title of The Troll: The Rise of Harry Potter."
