when brad jr. and his friends go to do that last job before he's arrested, there was five of them, but when brad sr. starts rampaging, he kills only three, what happened to the fifth guy??

Not too sure if the guy Kiefer played (Tim) was actually a member of Brad Snr's gang in real life. Previously read comments indicating this, I may be wrong.
I think the 5th guy was Keifer Sutherland's character, who is still alive at the end of the movie (he's present when all enter the courthouse).

i couldnt recognize kiefer at first, as i've always seen him with blonde hair in his films and tv shows.this is the only time i've seen him with black hair.is his hair naturally black ?.
i didnt understand why he wasnt killed either, since he was part of brad jr's gang.
i the film, i can understand why he wasn't murdered; his character was peripheral other than the one scene in the trailer and the courthouse scene. in real life, i guess he just got lucky.
