It was filmed in New Mexico, whether or not it actually takes place there, I don't know. I would assume that it takes place in the late 1800s.

I believe it's set in California, and by the prominence of the Winchester rifle (an appropriate tribute, I think, to the "Gun that Won the West") in the movie, it can't be set before 1873, as that was when the Winchester was first designed.

I don't think it was set in California. During the movie, Emmett says, "I'm going to California with my brother Jake." I know it was filmed in New Mexico, but I also think it was set in New Mexico.

The town of Turley is mentioned, which is in New Mexico.

Using guns as a means to determine a western's timeframe doesn't really work. Those movies are notorious for anachronisms when it comes to firearms. For example: John Wayne often used a Winchester '92 in films set well before 1892, like in "The Searchers", which takes place 3 or 4 years after the civil war.

And not to be nitpicky, but while arguably the most famous, the Winchester '73 wasn't the first Winchester rifle. That would be the 1866 model.
