COPYRIGHT? Anybody know how to get it?


Hey. Just finished watching it. What a screwed up movie! A friend of mine did a show where he used influences and references from ILSA to great effect. I made a documentary about the making of the show, and he asked me to put in some ILSA footage. He claimed that the rights to this film were not held and anyone can do what they like with it(i.e. put it in a documentary that is relevant to the film).
I'm leery to put it in because what if he is wrong? Anybody know if that might be a problem to put into my film? It is not a studio film, just an independent, although I'd like to send it to some festivals.

Seeing that two of the Ilsa films were released to DVD relatively recently, I suspect that someone still holds the rights. You may want to look into it, especially if you're going to send it into some flim festivals, as you'd probably be disqualified if you didn't have proper authorization.

By US Law a Filmographer or Photographer automatically own the copyright to their works while with most films the rights have basically been waived same way as an AP Reporter doesn't own what he shoots while on the clock. If you want to use the film or any part of it you will probably have to do some leg work. Due to the age of the film and since I do not know who actually did the film I can not help you find who would own it today. If you use it and the wrong people find out they could sue for damages. Unfortunately Copyright infringement is not only punishable by criminal judgments the civil liability can really eat you up.
