I wondered that myself, because after the cops bring her to his house, she says she saved him a trip to juvenile hall, and that she knows he would come to get her at juvenile hall. Someone else said, that may be Breezy manipulating the cops so they'll bring her to his house, but then why would she say that to Frank after the cops are gone? If Breezy was 17, Cali's law is confusing (as of 2011):
For the purposes of this section, a "minor" is a person
under the age of 18 years and an "adult" is a person
who is at least 18 years of age.
(c) Any person who engages in an act of unlawful sexual
intercourse with a minor who is more than three years younger than
the perpetrator is guilty of either a misdemeanor or a felony, and
shall be punished by imprisonment in a county jail not exceeding one
year, or by imprisonment in the state prison.
(d) Any person over the age of 21 years who engages in an act of
unlawful sexual intercourse with a minor who is under 16 years of age
is guilty of either a misdemeanor or a felony, and shall be punished
by imprisonment in a county jail not exceeding one year, or by
imprisonment in the state prison for two, three, or four years.).
Note they make a distinction if the person is under 16, not under 18. It seems like, if the first person is over 16, but under 18 and the second person is over 21, then it's a misdemeanor or a felony, but if the first person is under 16, then it's definitely a felony. So I'd bet if the first person is over 16, but under 18 and the second person is over 21, it ends up a misdemeanor, if they prosecute at all.
At any rate, in the 70's, if I'm not mistaken, the age of consent in Cali was 16, so Breezy was of age (then).
