Jailbait?


There is a scene where the cops picked her up for curfew. She even talked about how (Holden) would have picked her up from juvenile hall... In another scene she mentioned that she graduated high school a year earlier, meaning she's 19. Anyone else pick up on this?

She is supposed to be 19 in the movie. Kay was born in 1953 and the movie was made in 1972/1973, so the age of the actress is correct. The only thing I can think of is she told the cops she was younger than she was...I always wondered about that too - could just be a mistake in the consistency of the movie.

Is it possible that Juvenile Hall back in 1973 was a jurisdiction for 21 and under?

She lied, so she could have police to persuade Frank into taking her in his house. Adult would have been put to jail or left drifting, depending if any laws were broken.

I wondered that myself, because after the cops bring her to his house, she says she saved him a trip to juvenile hall, and that she knows he would come to get her at juvenile hall. Someone else said, that may be Breezy manipulating the cops so they'll bring her to his house, but then why would she say that to Frank after the cops are gone? If Breezy was 17, Cali's law is confusing (as of 2011):

For the purposes of this section, a "minor" is a person
under the age of 18 years and an "adult" is a person
who is at least 18 years of age.

(c) Any person who engages in an act of unlawful sexual
intercourse with a minor who is more than three years younger than
the perpetrator is guilty of either a misdemeanor or a felony, and
shall be punished by imprisonment in a county jail not exceeding one
year, or by imprisonment in the state prison.

(d) Any person over the age of 21 years who engages in an act of
unlawful sexual intercourse with a minor who is under 16 years of age

Note they make a distinction if the person is under 16, not under 18. It seems like, if the first person is over 16, but under 18 and the second person is over 21, then it's a misdemeanor or a felony, but if the first person is under 16, then it's definitely a felony. So I'd bet if the first person is over 16, but under 18 and the second person is over 21, it ends up a misdemeanor, if they prosecute at all.

At any rate, in the 70's, if I'm not mistaken, the age of consent in Cali was 16, so Breezy was of age (then).

As far as I know (and I grew up in San Diego) the age of consent in California has always been 18.So,Breezy would be certified San Quentin Quail,i.e.jailbait,under California law.

she said she graduated from high school a year before. Most people graduate at seventeen or eighteen, so unless she had skipped a grade, she was eighteen or nineteen at the time of the story. Legal.
