What if there had been a jury trial for the rape?


I am firmly of the opinion that the "rape" scene was truly a rape, irrespective of her enjoyment. But what if this exact set of facts occured in real life and she pressed charges and there was a trial? If she described to a jury that she was moaning with pleasure midway through the rape, would they find him guilty? Would the verdict be different today than it would have been in 1970?

First guy = not a rape because i could not say beyond a reasonable doubt that it was completely non-consensual.

Second guy = clearly a rape.

The rape occurred the moment he forced himself on her. The rape can't be undone by subsequent actions. Basic logic continues to elude you.

Yes it can. I was conceived when my father raped my mother. They have been married together for over three decades. Would you have me grow up without a father because him in jail because my mother didn't originally consent but grew to love him eventually.

If Amy was going to press charges with rape and it was going to go to a jury trial, she certainly wouldn't say that she enjoyed it on the stand. Therefore, a jury would not be aware of her possibly enjoying parts of it.

It can 'become consensual sex after the initial assault.' Are you serious? Once penetration occurred without consent, with her screaming and crying, THAT is rape. Period.

Yes. 1970 was very different in it's views on rape. Her sexual history would be used against her, she would be shamed and blamed. There is no way to prove in court she received pleasure, just his word against hers. But she would be raked over the coals. Today, views on rape have advanced. A woman's history may not be used against her, the initial use of force and a knife makes it an assault. She stands a better chance of conviction now than then.

They couldn't prove it so No rape conviction they didn't even have DNA testing. If by chance they magically had Movie Projector capture the entire rape I still think the first guy walks. He used to date her years ago and she was kissing him and running her fingerrs through his hair. The 2nd guy though is obviously a Rape.
