I'm asking because, if he wasn't, why didn't they kill him off in the movie?

There was a "bounty hunter" named, IIRC, Buckshot Roberts, who went after the Kid and several other of his "Regulators". He managed to kill Dick Brewer, but was killed by the other regulators at Blazer's Mills. in my opinion Nodeen is based partly (barely) on Roberts. Roberts was, by all accounts, one tough, mean SOB.

After Dan makes his escape, Billy takes off after him. Perhaps they were planning a sequel based on that pursuit?
shareUnlikely. Sequels were much rarer in those days. For all his popular films, John Wayne really only made one true sequel, "Rooster Cogburn and The Lady". Please don't mention the Cavalry "Trilogy". Those were based on short stories where the original author used similar/same names, but were not intended as truly the same characters.
