That's the point; he was only interested in facts. Fact: the boys did rustle the cattle. Fact: they rode with Miller who killed a man. The judge wasn't interested in hearing extenuating circumstances because he didn't have time. He was the only judge in Fort Grant, and he had several cases a day to adjudicate.

He did know what Cooper was going to say. When Cooper brought in the three originally, he told the judge that the boys didn't help Miller when Miller jumped him and that if the boys had helped Miller, he would have been overpowered. The judge then asked Cooper if the boys helped Cooper when Miller jumped him, and he said no. If the answer to that question was yes, the judge would have listened to Cooper's testimony regarding that and given the boys leniency.
I'll NEVER forget the POS character that Pat Hingle played in "One-Eyed Jacks" with Marlon Brando 7 years before this film! Hingle did a very convincing 'villain' role, and he was a villain in this film too, AFAIC! (Even tho he was a 'judge'). Hingle was also good in "Splendor In The Grass". EDIT: It was Karl Malden in One-Eyed Jacks! I get Hingle and Malden mixed up.(same noses)
