The one who gave the long speech on the gallows what was he
convicted of? He was drunk when they brought him in. Was it rape or murder. Of course, Jay Walking was a hang-able offense back then as well.

I always thought it was something serious but most certainly morals related. If he had rustled a cow drunk that crime wouldn't seem to evoke speak of the devil's hand.
My guess it was a rape or child molestation, an act that would have have been something he would never have done without his inhibitions being totally removed by the bottle.

He's just someone who was convicted of a hanging offense, and has "found religion", and as per the religion, he's blaming his offense on Satan, and the tool of Satan (liquor).

Well, rape is a morals related offense..
Francis Elroy Duffy doesn't look like the kind of guy who would murder anyone or rustle some cattle. Unlike the other convicts, he's timid and sort of bookish and very well spoken. He's dressed in a collared shirt. He looks like a school teacher, banker, or maybe even a minister of some kind.

There is a brief scene earlier where Duffy in the courtroom is pleading with the Judge and says (from memory):
Please, I was drunk. I didn't mean to touch her.
Duffy was also in the wagon when Jed Cooper comes to town. He has collapsed and his head is hauled up so Rachel can see his face. share
