What happened to Frank Miller's third henchman?

We see two of them gunned down before the ringleader himself is killed. One can presume that the third man ran off at some point, but where was he when Kane came out to face Miller when Mrs. Kane was his hostage?

You're probably asking about Ben Miller since it's pretty obvious when Pierce and Colby are shot.

Ben Miller is killed shortly after he breaks the window to steal the hat. The four gunmen are about to start down a side street when Kane steps out a block away and calls out "Miller!" and then fires a shot. Hardly noticeable, one of the gunmen starts to stagger with his back to the camera. He is actually almost out of the camera view.
At this point the camera POV is right behind the gunman, looking down the street at Kane.

Later Amy runs past the store and sees Ben Miller dead on the ground, lying on top of the hat.

I never understood why it was filmed that way with the audience hardly seeing the bad guy getting shot.
