Why did Mr. Smith not donate the land to his boys?


During the whole filibuster I thought Mr. Smith now comes with the idea of using the very thing he was accused of to his own advantage.

In the committee they show all the documents that "prove" that Jeff Smith owns the 200 acres of land. Well, if he owns the land by right he can do with it whatever he wants. Why not coming forward with the idea of donating it to the boys, set up a camp, maybe on his own cost and be done with it? If he owns the land now (after Taylor forged all these documents) he should be able to use it as he pleases and the dam can't be built anymore.

Yes but that would imply that he did own the land. I am not very familiar with american law but i think if his ownership of the land is established that would lead him to jail on the premise that he wanted to pass a law for his personal gain.

so yes he would stop them from building the dam but also ends up in jail, destroy his reputation and Taylor and Pain would still be in their position without any permanent damage.

It's more important to show the fraud and show the truth than live the lie even if there is a positive outcome.

That would reek of guilt. People would think he was caught red-handed so he tried to play innocent. Plus, Mr. Smith is not the calculating type. That's how Paine ended up the way he is. He started out with good intentions but gave in to the game of politics. Mr. Smith didn't play the dirty game. He stood his ground and spoke the truth regardless of consequences.

yeah, but when he introduced the bill, he said the government loan was going to be paid back by donations from the state's kids. it was too late to say that.

he was on record that he was "planning" to steal from kids, which is fraud and all that. it doesn't matter if he changes his mind and decides to donate "his" land.
