Great, but what does this have to do with THE GENERAL?

I'm doubtful. More likely is that they'll be releasing his M-G-M silents. THE GENERAL is a public domain film and I would be surprised if Warners released an edition of it.

Warner has rights to a LOT of films. They control most of MGM's older stuff, HBO, New Line, BBC and their own stuff. Odds are that "The General" falls under one of those categories. I own the Kino version and it's worth the purchase, but undoubtedly the Warner version will be better.

That list was from a chat on the Home Theater Forum which I took part in, it's just a summary of the titles (major ones) that we can expect from Warner over the next year (and some others will surely come out as well).

I garuntee Warners won't be releasing it. They don't own the rights to it, and it wasn't one of his MGM pictures. The best materials are public domain, so a better edition than Image's latest one would probably be rather hard to pull off.

some of that info is inaccurate, but it's still cool.

I was wondering though, how do you find out what stuff is public domain?

reply

I can garuntee you it's accurate. Once one edition of a lesser known film is put out, particularly when it's PD, a larger company will almost never put it out and try to compete because the niché has been filled and it's impossible.

Public Domain is on a case to case basis, but what institutes it is:

-Any work registered before Jan. 1, 1923
-Any work that was not renewed after 1964 fell into PD in it's 28th year. To check on the copyright status of works from the 1923-63 era, it is therefore necessary to determine whether the copyright was renewed.
-Anything produced from 1964-1977 was protected for 28 years, and is now automatically protected for 67 years on the second term.
-Anything *created before 1978 but not published* is protected for it's duration plus 70 years OR December 31 2002, whichever comes first.
-Anything created before 78 but published between then and 2003 is protected for its duration plus 70 years or December 31, 2047 whichever comes first.
-Anything created in 1978 to present day is it's duration plus 70 years (or if work of corporate authorship, the shorter of 95 years from publication, or 120 years from creation). Term of joint works is measured by life of the longest-lived author.

Between 1923-1963 under the 1909 Act, works published without notice went into the public domain upon publication. Works published without notice between 1-1-78 and 3-1-89, effective date of the Berne Convention Implementation Act, retained copyright only if registration was made within the following five year "grace period" Congress has allowed.

THE GENERAL was published without formal notice- prints say "Copyright Joseph Schenck", but give no year. Copyright, Author, and year are imperative notices.
UA also forgot to renew the copyrights on their Keaton films, which they could have, but didn't.

The owner of a copyrightable work can decide to place the work in the public domain, by adding a notice to the effect "The owner of the copyright in this work makes no claim of copyright and places this work in the public domain." If the owner dies or the company folds and does not pass the rights on to anyone.

Bastards! I want the SE to see Ridley Scott's *true* director's cut (he says that he felt the DC in the 1990s was too rushed and fell short of his real DC).
