Trump erupts. Claps back at Supreme Court Chief Justice John Roberts, insists there is no independent judiciary.


Well this is interesting.

Is Trump too stupid to recognize he might just be antagonizing the very people who might ultimately decide on his fate? I think that's an unequivocal yes, especially when you consider that with Kennedy replaced by Kavanaugh, it's Chief Justice John Roberts who could wind up being the key swing vote in any decision that divides down partisan lines.

Yesterday Trump criticized the 9th Circuit Court of Appeals for striking down the president’s ban on migrants seeking asylum, ruling it was unconstitutional. Roberts took issue with Trump's response to a reporter: “This was an Obama judge. And I’ll tell you what, it’s not going to happen like this anymore. ”

Roberts issued a classy statement by the Supreme Court today chastising Trump:

"We do not have Obama judges or Trump judges, Bush judges or Clinton judges. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them," Roberts said in a statement that was released by the Supreme Court after a query by The Associated Press.

On the day before Thanksgiving, he concluded, "The independent judiciary is something we should all be thankful for."


Trump of course was having none of it. He tweets:

“Sorry Chief Justice John Roberts, but you do indeed have “Obama judges,” and they have a much different point of view than the people who are charged with the safety of our country,” Trump tweeted. “It would be great if the 9th Circuit was indeed an “independent judiciary,” but if it is why are so many opposing view (on Border and Safety) cases filed there, and why are a vast number of those cases overturned. Please study the numbers, they are shocking. We need protection and security – these rulings are making our country unsafe! Very dangerous and unwise!”

I can picture John Roberts shaking his head reading that while muttering "What an idiot!" to his colleagues on the court. Should Trump throw his fate at the mercy of the court, it'd be your move John. A golden opportunity to provide a "teaching moment" to the president and the nation that the judiciary really is independent.

Update: LOOOLZ. Chuck Grassley has decided to weigh in on this by naturally taking Trump's side and upbraiding John Roberts. Chuck tweets:

"Chief Justice Roberts rebuked Trump for a comment he made abt judge’s decision on asylum I don’t recall the Chief attacking Obama when that Prez rebuked Alito during a State of the Union"

Chuck needs to remove his mouth from Trump's ass cheeks and retire his senile self because Roberts actually did raise his voice at the time by saying Obama's comments were "very troubling".

He's NEVER specific unless he's providing numbers or statistics he's pulled out of his diaper & with Mueller tick-tick-ticking towards indictments, that diaper is constantly filled.

I've given up on the hapless task of trying to disseminate his incoherency. The manchild doesn't even know how to spell very basic words.

But just for shits and giggles I'll make an effort here to decipher what he's saying and even try my best to steel man his argument. I think he believes brown skinned asylum seekers are a danger to our country and blames bleeding heart Obama appointees on the 9th Circuit for not sharing in his collective vision because he just had his ban struck down.

But as usual his arguments always fall apart at the slightest scrutiny. First, it was a district judge that struck down his ban, not a judge sitting on the 9th Circuit. Second, the ban wasn't a permanent ban. The district judge that struck it down ruled it unconstitutional to enforce the ban before the 9th Circuit decides. Third, Trump doesn't seem to realize that the Supreme Court could have chosen to review any 9th Circuit migrant case Trump is bitching about being overturned if they thought it wrongly decided. The fact that they didn't and instead allowed them to stand means they implicitly share responsibility in upholding the ruling. So why blame the 9th Circuit and not Judge Roberts himself? Could this be Trump's way of subtly criticizing Roberts by 9th Circuit proxy? Nope, because he's not that clever; in the past when he wanted to criticize Roberts he's done so with no filter. He just doesn't do subtlety because he's a blunt object.

Yet just his core argument, that asylum seekers are a threat to national security, doesn't make even the slightest bit of sense. So even doing my best steel man is shambles because the guy is bonkers.

Thank you for that detailed explanation of what he's "thinking". For the life of me, I couldn't figure out where he was going with that inane reasoning - now it kind of makes sense (T-rump sense).

I'd love to see Roberts get the last laugh. What would take my breath away is if Mueller said fuck it and chose to challenge OLC precedent by filing an indictment of a sitting president. Trump would contest and it'd be decided by the Supreme Court.

The ultimate would be a unanimous 9-0 beat down with Roberts authoring the consensus opinion emphasizing country and rule of law over party and partisanship before once again telling him there are no "Trump judges"; but that he should get ready to be deposed.

That's a Hollywood ending that'll never happen, but I can dream. :)

Still plenty of other manifestations of the same outcome that have a far better chance of happening I can hope for, but it probably won't be a 9-0 unanimous decision. 8(
