Why didn't Ginsburg retire under Obama?

She was already old and sick with cancer when Obama was President. She could easily have retired during his second term and ensured a Democrat would replace her. Why didn't she? Selfishness, reluctance to relinquish her power, or what? She certainly didn't do her party any favors with her decision to hold on to the bitter end, did she?

reply

old people love telling others what to do

reply

I don't know what at stage the senate became a Republican stronghold and I don't know when the cancer that killed her took hold and nobody anticipated Trump's win. If she believed in what she was doing and was doing it well then obviously keep doing it - I don't belive it's necessarily selfishness on her part - but it was very poor timing.

reply

It was very poor planning, not to mention reckless beyond belief.

reply

With hindsight - absolutly!
But it's a tragedy that the court should need planning and management to maintain some kind of balance.

reply

Planning? She was 87 years old. People in their 50’s routinely buy cemetery plots and funeral insurance, because it becomes very clear around that age that you won’t live forever. What the hell did she expect? Besides, did she think that the country really needed a geriatric on the court?

reply

Republicans controlled the Senate in Obama's second term. They are the ones who vote for Supreme Court Justice.

It is now a pure majority (51 votes) instead of two thirds.

High odds Obama's pick would not have passed the Republican controlled Senate.

reply

Are you saying they would have held it up for 4 more years?

reply

No but the Republicans would veto a leftist pick. Dems would have gotten a moderate.

They changed to a majority vote in April 2017....one of the worst things for the country, this insures hyper partisanship.

reply

Democrats controlled the senate his first term when she came down with cancer.2009.Although in tyhat era she was just getting hyped with Obama so I think she thought a new world was getting made and just stay on getting noticed with it.

reply

She was also a star for the far left.

Any replacement would have to be a moderate unless the Democrats had a super majority in the Senate.

A move from far left to moderate could be crowd by Republicans as a victory.

reply

Yes that is true with back then it was a 60 vote to pass.

reply

The simple answer is she didn't think Trump would "win".

reply

She thought Hilary was going to win in 2016 and wanted her to pick her replacement.
