this YouTube guy has a real problem with Kevin Smith, is he right?

Well...
Smith shares his podcast for free. If you are a fan, I guess that the honest thing would be to encourage people to listen to it on Kevin's site.

Now... I'm not following Kevin Smith's podcast world as much as I follow him as a film maker and I don't know about those double standards he talks about. I've never seen Smith using anything else than his own voice on his podcasts.

Could he be paying the rights to show those clips? Could it be fair use?

If someone is doing something exactly by the same method, show a clip, then create original content talking about it (I'm assuming he does that), I can see the problem.

If someone is just uploading random clips from his podcast, or whole shows (not doing anything else)... I can see Smith wanting it down. He's the creator and he gives the content for free.

true, but if Smith is profiting from using other people's actual footage, then how come people can't use clips of him talking?
