Does it matter? She was drunk behind the wheel of a car. Just because wasn't uncontrollably black-out wasted, swerving all over the road doesn't make her any less guilty. The limits set on the amount of alcohol you can consume before getting behind the wheel aren't just suggested guidelines here, they are absolute maximums.

she was 0.09 when the california limit is 0.08. she was hardly drunk, just a tiny bit over the limit, she probably didn't even realise she was. and she's not even being charged for this, so minor was it considered.

Yes, it does matter. She is guilty if she was over the limit, but if you are suggesting that her conduct is the same as someone who was blackout drunk you are a complete idiot. Someone who is two or three times the legal limit poses a far greater threat to society. Many people who get a 0.09 level get a wet and reckless. If she did break the rules, she should be punished accordingly. To answer your question, "yes, it absolutely does." There is a huge difference between being .09 and being .2, and the courts tend to show more leniency to the former, as they should.

I'm all for punishment fitting the crime, but honestly with the slew of recent DUI's plaguing Hollywood, it hardly seems fit to start touting leniency on the issue. Not that she should be made an example of or any such thing, but just that she should be expected to live up to the punishment accorded to crime she committed. Maybe she didn't realize she'd had enough to break the limit, but unless she was somehow accidentally consuming alcohol, she was taking a big enough risk to be asked to live up to the consequences.

What is it with these lousy celebrities and drunk-driving? I mean they can certainly afford a cab or definitely a chaffeur and yet they get behind the wheel of a car and go on their merry way without regard to the risk they pose to others.

I look forward to the day when one of these 'retards' ends up killing someone not-so -high -profile while intoxicated and see how that goes over for their career and the blase attitude of this industry towards the issue.

Trust me folks. The day isn't that far off at this rate.

How is a celebrity driving drunk different from anyone else? She should be dealt with accordingly. Probably 95% of the people who are picked up can afford cabs. Your anger should be directed towards all those who drink and drive. The fact that the celebrity should have nothing to do with how upset you are at the offending individual, if it does you are an absolute fool.

Why do you look forward to the death of an innocent person? Celebrities do not commit DUI type offenses at a higher per capita rate than the masses, so they have not failed to learn about the dangers of driving under the influence any more than society as a whole. You would be more intelligent to direct your anger towards drunk drivers as a whole, than celebrities who drive drunk. Thousands of people a year are killed by non-celebrity drunk drivers. You would be wise to direct your fear and anger towards that population, as it poses an astronomically greater threat to your well being.
