If they changed the law after the incident why are the defendants in the Arbery
case still guilty? If they were guilty there would be no reason to change the law. The law is what was the law at the time not what it was changed to.
shareThe judge narrowed the definition of citizen's arrest during the trial and it took away the defendants right to make the citizen's arrest. I think a more favorable outcome would have been reached if they could claim the citizen's arrest BUT I wasn't optimistic. The sad part is that the guy could have kept running but he decided to go for the gun. In addition to being a thief, Arbery suffered from schizoaffective disorder and he was off his meds and smoking weed. The judge also did not want to put the victim on trial so he excluded a lot of Arbery's medical and criminal history.
