Houston woman shoots peeping Tom dead. Did she jump the gun?


Houston woman shoots dead a peeping tom. Was this excessive force or a justified reaction? While I do believe peeping toms are committing crimes that warrant a jail sentence, I don't believe they should be executed. It would also be a dangerous legal precedent if every trespasser could be shot for being a peeping tom. There are situations where people approach the wrong home or accidentally walk on someone's lawn or property.

Well from the picture seen her yard is fenced in. You can't just accidentally walk up to the window in her yard.

The driveway is not fenced in and it would be hard to see at night. You didn't answer my question. Was the shooting justified?

There are situations when somebody would be confused and walk into somebody's yard. I don't think people should be shot for trespassing but others may disagree on this issue.

Clearly excessive force. Maybe they will find a lesser charge than murder given that she was in her home and had cause to be fearful. But "I was afraid" can't excuse emptying a rifle at the guy for standing in the yard and looking in the window. If he was in the house or even attempting to enter the house, it's a totally different story.

When I lived in a college town there were many occasions where students would get drunk, and on the way home forget where they were and walk into the wrong house to fall asleep. If it was legal to shoot people for being on your property or even entering your house there would have been a ton more shootings.

But in Texas the message they seem to want to send out is that it is the wild west and everyone should carry a gun wherever they want and shoot whoever they want for whatever they want. Clearly TX has gone crazy.

Sorry, but people have a right to shoot an unknown who has entered their home. Split second decisions are made. They shouldn’t have to wait to see if the home invader is up to no good.

No, but they do have to wait for them to actually be a home invader. The Houston woman fired from inside the house, through the exterior wall and struck the guy who had not been inside her house nor was attempting to gain entrance. "I was scared" is not enough. That's essentially the defense used by Capitol Police Lt. Byrd for executing Ashli Babbitt.

I was afraid for my life is all that is needed. We don’t know if he was trying to gain entrance. One thing is for sure…he won’t have a chance to invade her home. We don’t know what his intensions were. Five (5) seconds is all it takes to invade a home. Is it possible she stopped a home invasion? Just as the one I posted about earlier. The evil s.o.b. broke a window and murdered the grandmother. People shouldn’t have to wait until entrance is made.

Stick a nose on someone’s window from the outside and you just may get it blown off! In today’s times home invasions are on the increase and the scum bags aren’t waiting until the home is empty.

"Afraid for my life" is not all that's needed; that fear needs to be reasonable given the circumstances. He was outside the house, she was inside. There was no indication he had a weapon. She was armed and ready to defend herself in a second if he did anything to threaten her life. Claiming she feared imminent death in that situation is not reasonable, just like Lt Byrd's claimed fear of imminent deadly force from a 5'2" unarmed woman who hadn't even made it through the window opening was not reasonable.

As I continue to write we don’t know what his intentions were. He easily could have breached the window and over taken her. Do we know if an accomplice was preparing to invade the home elsewhere, heard the shots and ran. Home invasions are usually 2 or more. Yes, he was outside, but would he have entered seeing a lone woman. Should she have waited until he broke the glass?

He doesn’t have to have a weapon. He was a man who most likely was stronger so his hands were weapons.

To sum it up if I as woman saw a man at my window looking inside I would fear for my safety. I would hope I could react the way she did.

One evening about 11:00 my husband and I were in the living room watching tv when all of a sudden someone started pounding on our front door. My husband jumped up with gun in hand ready to shoot. He called the police, but he was ready to fire if the door was breached. The cops came and hauled him off.

The same thing could have occurred with the woman, but she defended herself by shooting first. The guy could have been preparing to breach.

Not justified, she should be charged with manslaughter, possibly with extenuating circumstances, and go to jail for some amount of time. Deadly force is only justified if you life is in danger, and from the descriptions you gave at no time was this woman's life in danger.

Wow you never wanna look out a window at night and see a face looking back at you.

He was either going to break in and do god knows what, or was casing the place to break in and do god know what down the road.
