8-year-old disabled child arrested for not sitting correctly in school


The boy has severe ADHD and diagnosed behavioral issues. The school knew and had educational and behavior plans in place that weren’t followed. The pending lawsuit says he was placed in a classroom and cafeteria setting which were not appropriate for him.

The boy was in the cafeteria when the substitute teacher told him to sit correctly. He didn't. She tried to move him when he said "Don't touch me." When she didn't remove her hands from him, he punched her in the chest once with his right hand. The teacher didn't report being injured nor appear to be.

When the two police officers arrived, the boy was sitting calmly and quietly in the hallway outside of the school office. The police decided to teach him a lesson by arresting him. They attempted to put him in handcuffs which were too large, and telling him he was going to jail. He was visibly upset and scared when he asked for his father. The police lied and told him he left the building which wasn’t true. At the same time, his mother was in the hospital having a tumor removed.

The boy was locked in the back of a police car, taken to juvenile hall where his mouth was swabbed, his DNA and mugshot were taken, he was fingerprinted and then locked in a cell for several minutes. He was charged with a felony battery charge. Those charges were eventually dropped.


The child suffers severe psychological injury as a result of the arrest which includes loss of breath, hives, stomach aches, headaches, insomnia, nightmares and refusal to sleep alone. Some of the psychological trauma may be permanent.

Federal lawsuit alleging civil and disability rights violations and excessive police force has been filed.

He was arrested for PUNCHING the teacher in the chest. Violent children need to be segregated from the general student body since they are a risk to other children. What if the problem child attacks a kid next? That could be your kid. I don't want my kids attacked by some juvenile delinquent. Teachers need to identify the problem children and send them to reform school before they attack other children.

I was randomly attacked by a crazy kid in middle school and witnessed a random attack in high school by a different crazy kid. Both of those guys were eventually expelled since they kept attacking people. Violent children need to be monitored and segregated EARLY so they don't hurt other students.

The teacher physically attacked the disabled child. He defended himself.

Punching somebody and threatening to have somebody beat your a@# is not self-defense. The officer even observed the child with clenched fists ready to attack again. That little thug needed to be removed from the classroom and he should be sent off to reform school.

The teacher asked him several times to sit down but he didn’t comply and she asked him to sit next to her.
He refused and told her, 'Don’t put your hands on me.' She then told the boy to walk with her and he told her, 'My mom is going to beat your a**' and punched her with his right hand.

Officer Michael Malgrat wrote in the report that he was in the school’s administrative office when the teacher and the boy arrived and the boy 'had his hands clenched in fists and he was postures as if he was ready to fight.'

You mistakenly believe a suicidal 8-year-old child with severe emotional and psychological issues can suddenly become normal by terrorizing him.

The school needed to follow the plan that was created by his doctors which was unfamiliar to his substitute teacher.

A responsible reaction would have been the boy, his father who was in the school, his teacher and the school psychologist meeting together and proceed from there.

Furthermore, this child was hospitalized for suicide and is on two different medications so he has his own psychiatrist who should have been consulted, also.
